1. Acceptance of Terms
By accessing or using tacomaaxe.com or participating in any services provided by Tacoma Axe Throwing LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree, you may not use our website or services.
These Terms apply to all visitors, guests, and participants who interact with our website, booking platform, or physical facility.
2. Eligibility and Age Requirements
Axe Throwing Activities (Live Lanes):
- Participants must be at least 13 years old to throw real axes.
- Ages 13–15 may participate only with a parent or legal guardian present.
- Ages 16–17 may participate without direct supervision if their parent or legal guardian has signed a waiver expressly authorizing unsupervised participation.
- Participants 18 years and older may participate independently with a signed waiver.
- A valid photo ID may be required for age verification.
Family or Foam Target Activities:
- Children under 13 may participate only in designated foam-target or family areas using soft equipment.
- A parent or legal guardian must remain present and sign a waiver for each child.
- Staff reserve the right to determine which activities are appropriate for safety reasons.
General Entry & Supervision:
- For safety and insurance compliance, unsupervised minors are not permitted in throwing or family-activity areas unless specifically authorized by waiver.
- Tacoma Axe Throwing LLC reserves the right to deny entry or participation to anyone who fails to meet these requirements.
3. Safety and Conduct
For the safety and enjoyment of all guests, participants must follow all posted rules and staff instructions at all times.
- Closed-toe shoes are required in all throwing areas.
- Alcohol may be consumed responsibly in designated areas and only if purchased on-site in accordance with Washington State Liquor and Cannabis Board (WSLCB) regulations.
- Throwing after excessive alcohol consumption is prohibited. Staff reserve the right to determine whether a guest is fit to participate.
- No outside alcohol or controlled substances are permitted on the premises.
- Participants must be in good physical and mental condition to throw safely.
- Staff may refuse service or participation to anyone who appears intoxicated, disruptive, or unsafe.
- Any violation of safety or alcohol policies may result in immediate removal without refund.
4. Assumption of Risk & Liability Waiver
Axe throwing and related activities involve inherent risks, including injury or death.
By participating, you:
- Acknowledge and accept these risks,
- Assume full responsibility for your participation, and
- Release and hold harmless Tacoma Axe Throwing LLC, its owners, officers, employees, contractors, and affiliates from any and all claims, damages, or liabilities arising from participation or presence on the premises.
This release is intended to be as broad and inclusive as permitted under applicable Washington State law governing assumption of risk and recreational liability.
All participants must sign a liability waiver before participating.
5. Reservations, Payments & Cancellations
- Payment is required at the time of booking.
- Cancellations made 24 hours or more in advance are eligible for a full refund.
- Late arrivals or no-shows may forfeit their booking and payment.
- Tacoma Axe Throwing LLC reserves the right to reschedule or cancel sessions for safety, maintenance, or staffing reasons.
- Military and first responders may request flexible cancellation policies with valid ID.
- Refunds & Chargebacks: Refunds are issued to the original payment method. Unauthorized chargebacks may result in account suspension until resolved.
6. Pricing, Discounts & Promotions
- Prices, discounts, and promotions may change without notice.
- Only one discount may be applied per booking unless otherwise stated.
- Military and first-responder discounts require ID at check-in.
7. Code of Conduct
Guests agree to:
- Treat staff and other participants respectfully.
- Follow all facility rules and staff instructions.
- Not engage in dangerous or reckless behavior.
- Not use offensive language or engage in harassment.
- Respect the equipment and facility.
Violation of this code may result in removal without refund or future suspension.
8. Property Damage
Guests are responsible for damage to property, equipment, or facilities caused by negligence or intentional acts.
Repair or replacement costs may be charged to the responsible party.
9. Photography & Media
By entering the premises or participating in activities, you consent to being photographed or recorded for marketing or promotional use.
If you do not wish to be photographed, please inform staff.
10. Alcohol, Food & Beverage
Alcohol Service:
- Alcoholic beverages may only be consumed if purchased and served under our state-issued license in accordance with Washington State Liquor and Cannabis Board (WSLCB) regulations.
- Guests are expected to drink responsibly.
- Staff may deny service or participation to anyone who appears impaired.
- Outside alcohol is strictly prohibited on the premises.
Food Service & Third-Party Partners:
Tacoma Axe Throwing LLC may partner with third-party restaurants, caterers, or delivery services ("Food Vendors") to provide food options for guests.
All food is prepared, handled, and delivered solely by these independent vendors.
Tacoma Axe Throwing LLC does not control food preparation, delivery, or ingredient handling and is not responsible for food quality, temperature, contamination, allergens, or any adverse reactions.
By consuming food or beverages provided by third-party vendors, you agree to release and hold harmless Tacoma Axe Throwing LLC, its owners, employees, and affiliates from any and all claims or damages arising out of or relating to such food or beverage items.
Outside Food:
Guests may bring in outside food only as permitted by venue policy or private event agreements.
11. Online Transactions & Gift Cards
- All prices are in USD and subject to applicable taxes.
- Gift cards and digital vouchers are non-refundable and have no cash value, except as required by law.
- Lost or stolen gift cards will not be replaced.
- Payments are securely processed by third-party providers (e.g., Stripe, RKD Solutions). We do not store payment-card information.
12. Facility Rules & Private Events
- Private events, corporate bookings, and leagues may have separate rules or agreements.
- Management may adjust lane assignments or combine smaller groups for scheduling efficiency.
- Personal axes or throwing equipment are prohibited unless approved by staff.
13. Independent Contractors
Some instructors or hosts may operate as independent contractors.
Tacoma Axe Throwing LLC is not liable for their acts, omissions, or representations.
14. Data Privacy
Personal information is collected and processed according to our Privacy Policy and all applicable data-protection laws.
15. Indemnification
You agree to indemnify and hold harmless Tacoma Axe Throwing LLC, its owners, employees, and affiliates from any claims, damages, or expenses (including attorney's fees) arising from your participation or breach of these Terms.
16. Limitation of Liability
To the fullest extent permitted by law, Tacoma Axe Throwing LLC shall not be liable for indirect, incidental, or consequential damages.
Our total liability for any claim shall not exceed the amount paid for the session or product in question.
17. Force Majeure
Tacoma Axe Throwing LLC is not liable for delays or failures in performance caused by events beyond its control, including natural disasters, power outages, government orders, or pandemics.
18. Electronic Signatures & Waivers
Electronic signatures and digital acknowledgments carry the same legal effect as handwritten signatures.
Online waiver submission or acceptance during booking constitutes a binding agreement under applicable federal and state electronic-signature laws.
19. Binding Effect & Successors
These Terms are binding upon and benefit Tacoma Axe Throwing LLC and its successors or assigns, and apply to all participants and their heirs or representatives.
20. Third-Party Services & Integrations
Our website and booking system may integrate with third-party providers such as RKD Solutions, Stripe, or Brevo.
We are not responsible for the content, security, or practices of these third parties. Use of their services is at your own risk and subject to their terms.
21. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Washington.
All disputes will be resolved through binding arbitration in Pierce County, Washington, under the rules of the American Arbitration Association.
The prevailing party is entitled to recover reasonable attorney's fees and costs.
Judgment on the arbitration award may be entered in any court of competent jurisdiction.
22. No Waiver of Rights
Failure by Tacoma Axe Throwing LLC to enforce any provision of these Terms does not waive its right to enforce that or any other provision in the future.
23. Non-Assignability by User
You may not transfer or assign your rights or obligations under these Terms without prior written consent from Tacoma Axe Throwing LLC.
24. Severability & Entire Agreement
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
These Terms, along with our Privacy Policy and any signed waiver or supplemental agreement, constitute the entire agreement between you and Tacoma Axe Throwing LLC and supersede any prior understandings or communications.
25. Modifications
We may revise these Terms at any time. Updated versions will appear on our website and take effect immediately upon posting.
Continuing to use our services after updates constitutes acceptance of the revised Terms.
